On November 5, 2014, California voters passed Proposition 47, the Safe Neighborhoods and Schools Act. So for the next three years people with certain felony convictions can have them reduced to misdemeanors.

Are You Eligible to Have Your Felony Conviction Reduced to a Misdemeanor?

Prop 47 only allows certain felonies to be reduced to misdemeanors. Therefore, the first step in knowing if you are Prop 47 eligible is to know if your crime fits into one of the following categories:

Drug Felony Conviction Reduction

Prop 47 reclassified the majority of previous felony drug possession offenses as misdemeanors. So if you have drug felony conviction under Health & Safety Code 11377, 11357(a) or 11350, you may be allowed to petition for a conviction reclassification. It does not matter if the drug possession felony was old or recent.

Many people with one or more of this type of drug possession conviction will qualify for the felony reduction. However, there are some exceptions. For instance, if you have a previous felony conviction for a serious or violent crime, or certain sex offenses, then you may not be able to petition for relief under Prop 47.
